Our Commitment to Privacy

Your privacy is important to Akteena Inc. ("Akteena," "we," "us," or "our"). This Privacy Policy explains what information we collect, how we use it, and the choices available to you.

This Policy applies to personal information we collect through the Akteena website at akteena.com (the "Site"), the Akteena Platform and its related interfaces, our device management services, and our application programming interfaces (APIs), software development kits (SDKs), and related developer and integration tools (together, the "Services").

This Policy does not apply to Akteena's commercial products and services that are provided to businesses and organizations under separate agreements. Where you access an Akteena product or service through an organization — for example, as a driver in a vehicle equipped with an Akteena commercial device, or as a user provisioned by an Akteena customer or partner — the processing of personal information in connection with that product is governed by the agreement between Akteena and that organization (such as a Master Services Agreement, Data Processing Addendum, or original equipment manufacturer agreement), and by that organization's own privacy notices. If you are such a user, please contact the organization that provided the product or service to you for information about how your personal information is handled.

This Policy also does not apply to the Akteena consumer mobile application. If you use the Akteena consumer companion app, please see our Consumer Privacy Notice.

Our Role

Depending on the relationship and the type of data involved, Akteena may act as a controller (determining the purposes and means of processing) or as a processor or service provider (processing personal information on behalf of, and under the instructions of, a customer who is the controller). When Akteena processes personal information on behalf of a commercial customer through the Akteena Platform or related Services, that processing is governed by our agreement with the customer, and the customer is responsible for the lawful basis for processing, for any notices and consents required from individuals, and for responding to individual rights requests. This Policy describes our practices for the personal information for which Akteena is the controller.

What Information Do We Collect

We collect the following categories of information:

  • Information you provide to us. When you contact us through the Site (for example, by submitting a "Contact Us" form), request information, or communicate with us, we collect the information you choose to provide, such as your name, email address, company, and the contents of your message.
  • Account and subscription information. When you, your organization, or a partner is provisioned to access the Akteena Platform or related Services, we collect account credentials and related identifiers necessary to authenticate and authorize access and to administer the subscription.
  • Device, telemetry, and operational data. The Akteena Platform receives data transmitted from Akteena-connected devices and related systems, which may include device identifiers, telemetry, location data, event records, images, video, and diagnostic information. Where this data is processed on behalf of a commercial customer, it is handled under our agreement with that customer as described in "Our Role" above.
  • Automatic information. When you visit the Site, we automatically collect certain technical information, such as your IP address, browser type, operating system, referring pages, and information about how you interact with the Site.

Automatic Information and Website Analytics

We use Google Analytics 4 to understand how visitors use the Site, so that we can measure and improve its content and performance. Google Analytics uses cookies and similar technologies to collect information such as IP address, device and browser information, and pages visited. We do not use advertising pixels or retargeting cookies on the Site, and we do not sell or share Site analytics information for cross-context behavioral advertising. Cookies

The Site uses cookies. Cookies are small data files stored on your device that help a website function and help us understand how the Site is used. We use strictly necessary cookies required for the Site to operate, and analytics cookies as described above. You may set your browser to notify you when you receive a cookie or to decline cookies; if you decline, some features of the Site may not function properly. We honor Global Privacy Control (GPC) signals on the Site as a valid opt-out preference signal where required by applicable law. This Cookies section applies to the Site only.

How We Use Information

We use the information we collect to:

  • Respond to your inquiries and provide the information, support, or guidance you request;
  • Provide, operate, maintain, secure, and improve the Site and Services;
  • Authenticate and authorize access to the Akteena Platform and related Services;
  • Communicate with you about the Site, Services, and, where you have not opted out, about our products and offerings;
  • Detect, prevent, and address security incidents, fraud, and misuse; and
  • Comply with our legal obligations and enforce our agreements.

Any use of customer data for model development, machine learning, or artificial intelligence is governed by the applicable agreement with the customer.

How We Share Information

We do not sell your personal information, and we do not share your personal information for cross-context behavioral advertising. We share personal information only as follows:

  • Service providers. With third-party service providers and vendors that process information on our behalf to support the Site and Services (for example, hosting, infrastructure, authentication, and data-enrichment providers), under obligations that restrict their use of the information to the services they provide to us.
  • Affiliates. With our corporate affiliates and subsidiaries for purposes consistent with this Policy.
  • Customers and partners. Where we process data on behalf of a commercial customer, with that customer and with parties the customer authorizes, in accordance with our agreement with the customer.
  • Legal and safety. When we believe in good faith that disclosure is required by law, valid legal process (such as a subpoena or court order), or is necessary to protect the rights, property, or safety of Akteena, our users, or others.
  • Business transfers. In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, in which case personal information may be transferred as part of the transaction. We will provide notice of any such transfer that materially affects how your personal information is handled.

International Processing

Akteena is established in the United States. Personal information may be accessed, processed, and stored by Akteena, its affiliates, and its service providers in the United States and in other countries where we or they operate, which may have data protection laws different from those in your country. Where required by applicable law, we use appropriate safeguards for such transfers.

Data Retention

We retain personal information for as long as needed to fulfill the purposes described in this Policy, including for as long as an account or relationship is active, and thereafter as needed to comply with our legal obligations, resolve disputes, and enforce our agreements. Personal information that we process on behalf of a commercial customer is retained in accordance with our agreement with that customer.

Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction, including encryption of data in transit. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. In the event of a security incident affecting personal information for which we are responsible, we will provide notice as required by applicable law.

Your Rights

Depending on where you live, you may have certain rights regarding personal information for which Akteena is the controller. To exercise any right, contact us at privacy@akteena.com. We will respond as required by applicable law and will not discriminate against you for exercising your rights. If we process your personal information on behalf of a commercial customer, please direct your request to that customer; we will assist the customer as required by our agreement.

California residents. If you are a California resident, you may have the right to know the categories and specific pieces of personal information we have collected about you, the sources, the business or commercial purposes for collecting it, and the categories of third parties with whom we share it; to request deletion or correction of your personal information; and to not receive discriminatory treatment for exercising your rights. Akteena does not sell or share personal information for cross-context behavioral advertising, and does not collect or process "sensitive personal information" as defined by California law for purposes that would require an opt-out. You may use an authorized agent to submit a request, subject to verification.

Canadian residents. If you are in Canada, you may request access to the personal information we hold about you and request correction of inaccurate information. You may also contact the Office of the Privacy Commissioner of Canada.

Children's Privacy

The Site and Services are intended for businesses and are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact privacy@akteena.com and we will delete it.

Do Not Track and Opt-Out Signals

Because no common industry standard for "Do Not Track" browser signals has been adopted, the Site does not respond to such signals. As described in the Cookies section, we honor Global Privacy Control (GPC) signals where required by applicable law.

Marketing Communications

If we send you marketing communications, you may opt out at any time by following the unsubscribe instructions in the message or by emailing privacy@akteena.com. We may still send you non-promotional communications about the Site, Services, or your account.

Changes to This Policy

We may update this Policy from time to time. If we make a material change, we will update the effective date below and, where required by law, provide additional notice.
